Who Can Apply for the O-1 Visa?

If you are an expert in your field of work and possess exceptional abilities or accomplishments, you are eligible to apply for an O1 visa. Depending on your area of specialization, there are two different sorts of O1 visas: O1A and O1B:

If you have exceptional talent in the arts, sciences, education, business, or athletics, you can apply for an O1A visa.

If you have exceptional artistic talent or excellent success in the film or television industries, you may be eligible to apply for an O1B visa.

O1 Visa Eligibility Requirements

Depending on your area of expertise, you must fulfill the following requirements to be eligible for an O1 visa:

You must possess expertise that sets you apart from other practitioners in your profession, whether it be science, education, business, or athletics. You must fall within the “upper” percentages, in other words.

For individuals in the arts: You must be distinguished in the arts and have greater accomplishments than most. You should, for instance, be a well-respected, prominent, or well-known individual in the industry – someone who has.

For those in the film or television industry, distinctiveness is necessary, such as being acknowledged as someone with greater expertise than others and who is a major, well-known character in the field.

Additionally, you must be visiting the United States for a brief time to work in your field of competence.

How can I get an O1 visa?

When requesting an O1 visa, you and your company must do the following:

  •       On your behalf, your employer submits a petition to the USCIS.
  •       Form DS-160 is submitted. Anyone who requests a US visa must submit this computerized application form.
  •       The O1 visa fees are paid by you.
  •       You make an appointment with the closest US mission for a visa interview.
  •       assemble the necessary paperwork.
  •       Attend the interview at the US Consulate or Embassy and provide the paperwork.
